Arkansas Criminal Law

Legal advice and representation are essential at every stage of a criminal case, including before charges are even filed. Unless the police have personally witnessed the crime with which you are being charged, there will likely be an investigation period before charges are actually filed, during which time you may be interviewed, and other evidence collected. What you say and do at this stage can influence what charges are filed, if any, and your statements and actions may be used against you later at trial. Consulting with an attorney experienced in Arkansas criminal laws at this stage can be critical to whether charges are even filed and to protecting your rights should the case later come to trial.
We take a very hands-on approach with our clients who have been charged with a crime. We sit down personally with you and fully explain what law you are charged with violating, what the government must prove in your case, and what the penalties are. Our criminal defense law firm in Arkansas then conducts a thorough investigation, obtaining information from the government, interviewing witnesses, visiting the crime scene and gathering any other facts or information relevant to your case. We can then provide you with a firm understanding of the charges against you, the criminal laws in Arkansas, the evidence the government will present, and the potential defenses you may have in your favor.
With this information in hand, you will be prepared to make some important decisions regarding your case, such as whether you want to select a judge or jury trial or wish to explore the possibility of a negotiated plea agreement. Once you have made these decisions, we proceed along those lines and provide you with vigorous representation to secure the best possible outcome.

Family Law

In addition to criminal law in Arkansas, The James Law Firm also practices in the area of family law, assisting parties in divorce proceedings and the difficult issues of property division, spousal support, child custody, and child support. When these issues cannot be settled by the parties themselves, they are decided by the court after a hearing. Being represented in this process by an experienced family law attorney is critical to your success.
The residency requirement to file for a divorce in Arkansas is sixty days. Grounds for divorce, which must be proven in court, include separation (living apart) for 18 months, as well as fault-based grounds such as adultery, cruel and barbarous treatment, habitual drunkenness, and general indignities which render the situation intolerable for one or both spouses.
Child support is determined according to the Arkansas Family Support Chart, which factors payment according to the payor's net monthly income and the number of children to be supported. The judge may deviate from this chart if convinced by the evidence that it is in the best interests of the child to do so.
Spousal support, also known as alimony, may be ordered to be paid by one spouse to the other, based on the requesting spouse's needs, the paying spouse's ability to pay, and other factors which the court deems relevant.
The court divides marital property and debts in an equitable fashion between the spouses. Equitable does not mean equal, and while the distribution is normally one-half to each party, the court may allocate the property differently based on a number of factors such as the needs of each spouse and their personal assets and earning potential.
Whether you are need of a family attorney or a criminal law firm in Arkansas, The James Firm is eager to assist you with your legal issues.
